Copyright Policy
Last updated: August 1, 2026
1. Purpose and scope
GlobalBay, operating NexoRush (“GlobalBay”, “NexoRush”, “we”, “us” or “our”), respects copyright and other intellectual-property rights. This Copyright Policy explains the standards for content uploaded to NexoRush and the process for reporting, reviewing and challenging alleged infringement.
This Policy applies to Sellers, Buyers, visitors, rights holders and their authorised representatives. It covers product listings, product files, previews, images, text, portfolio materials, user profiles, blog content, service listings, freelance deliverables and other content stored or displayed through NexoRush.
This Policy must be read with the Terms and Conditions, Seller Agreement, Licensing Terms and Privacy Policy. It does not replace a court procedure or provide legal advice.
2. Platform role and ownership
NexoRush operates a marketplace and acts as Merchant of Record for transactions completed through the platform. Sellers and other users may provide content that NexoRush stores or displays. Acting as Merchant of Record does not transfer ownership of Seller copyright to GlobalBay.
Each creator or rights holder retains the intellectual-property rights they lawfully own. Sellers grant GlobalBay the limited rights described in the Seller Agreement so that GlobalBay can host, market, distribute, license and deliver their products or services through NexoRush.
Purchasing a digital product normally grants a limited license under the Licensing Terms. It does not transfer copyright unless an express written assignment states otherwise.
3. Seller and uploader responsibilities
Before uploading or supplying content, you must ensure that you own it or hold every licence, consent and permission needed for NexoRush and Buyers to use it as described. You must be able to provide evidence of those rights when reasonably requested.
You must identify material third-party content and comply with its licence, attribution, redistribution and commercial-use conditions. This includes fonts, photographs, icons, music, video, datasets, themes, plugins, libraries, code and open-source components.
You must not upload:
copied, pirated, leaked or unlawfully scraped material;
content taken from another marketplace, website or repository without sufficient rights;
content that removes or falsifies copyright, authorship, provenance or licence information;
material generated or modified using a tool where you lack the rights required for commercial distribution;
third-party trademarks, characters, logos, designs or personal likenesses in a way that infringes applicable rights; or
content subject to a licence that is incompatible with the permissions offered through NexoRush.
4. Buyer and Licensee responsibilities
Buyers may use purchased content only within the selected license. Unless expressly permitted, a Buyer may not resell, share, sublicense, mirror, republish or distribute the original or modified source files.
A Buyer must not remove provenance records, activation data, copyright notices or legally required attribution. Restrictions and permissions for Personal and Commercial Licenses are explained in the Licensing Terms.
5. NexoRush materials and branding
The NexoRush name, logos, interface, original text, graphics, code and other platform materials are owned by or licensed to GlobalBay. Access to the platform does not grant permission to copy, imitate, scrape, republish or commercially exploit those materials.
You may link to public NexoRush pages and use platform-provided sharing tools. You may not suggest that GlobalBay endorses you, register confusingly similar branding, or use NexoRush assets outside any published brand guidelines without permission.
6. How to report alleged infringement
If you believe content on NexoRush infringes copyright or another intellectual-property right, send a sufficiently precise and substantiated notice to:
GlobalBay — Intellectual Property Notice
De Nieuwe Erven 3 Unit 13664
5431 NV Cuijk
Netherlands
Email: support@nexorush.com
Suggested subject: Copyright Infringement Notice
Submitting a notice does not require certainty that a court would find infringement. It does require an honest, accurate and complete explanation that allows us to identify the content and assess the allegation.
7. Information required in a notice
Include:
your full name and email address, and the organisation you represent, if any;
an explanation of your authority if you act for the rights holder;
a clear description of the protected work or right, with registration details where relevant;
the exact NexoRush URL, listing ID, file, profile, message or other electronic location of the reported content;
a sufficiently substantiated explanation of why the content is unauthorised or unlawful;
supporting evidence, such as an original publication, source file, licence record, registration or dated ownership material;
any territorial limitation relevant to the claim;
a statement confirming your good-faith belief that the information and allegations are accurate and complete; and
your typed or electronic signature.
Do not send unnecessary identity documents, passwords, payment-card data or unrelated personal information. If sensitive evidence is necessary, ask us for a secure method of transfer.
8. Incomplete or unclear notices
If a notice does not identify the content or legal basis with sufficient precision, we may request clarification or supporting material before deciding. A general allegation against an entire Seller, category or website may be insufficient without identifying the relevant content.
Failure to respond may prevent further assessment. We may still act where the available information independently establishes a legal, security or policy violation.
9. Review of notices
Where contact information is available, we will confirm receipt without undue delay and process the notice in a timely, diligent, objective and non-arbitrary manner. We may assess:
whether the notice identifies the content and relevant rights;
whether the complainant appears authorised to submit it;
licences, assignments, copyright exceptions and other lawful uses;
the Seller's evidence and transaction records;
the urgency and potential harm of continued availability; and
whether a restriction should be limited by content, territory, visibility, download access, payment or account function.
We may consult the affected user, the complainant, qualified advisers, trusted sources or competent authorities where appropriate. NexoRush does not determine complex ownership disputes with the authority of a court.
10. Possible actions
Depending on the evidence and risk, we may:
take no action;
request additional information or a correction to the listing;
limit visibility, suspend sales or disable downloads;
remove or disable access to specific content;
hold a related payout while a claim or transaction risk is reviewed;
cancel or refund affected transactions where justified by law or policy;
preserve evidence and transaction records;
restrict or terminate an account in serious or repeated cases; or
comply with a court, authority or law-enforcement order.
Measures should be proportionate to the available evidence, the scope of the alleged infringement, the rights and interests affected, and the risk of continued harm.
11. Notice of our decision
Where the notifier supplied electronic contact details, we will notify them of our decision without undue delay and explain available redress options where applicable.
Where we restrict content or an account and know the affected user's electronic contact details, we will provide a clear and specific statement of reasons where required. This may identify the type, scope and duration of the restriction, the facts and contractual or legal ground relied on, whether automated means materially contributed to the decision, and available appeal options.
We may withhold information where disclosure is prohibited, would create a material safety or fraud risk, would compromise an investigation, or is not required by law.
12. Seller response and counter-notice
If your content is restricted and you believe the decision is wrong, email support@nexorush.comwith the subject Copyright Counter-Notice.
Include:
your account email and the affected listing, content or order reference;
the decision or notice you are challenging;
a clear explanation of why you believe the content is authorised, original, licensed, non-infringing or protected by an applicable exception;
supporting evidence, such as source files, licences, agreements, publication history or permissions;
a good-faith statement that your response is accurate and complete; and
your typed or electronic signature.
This EU-focused procedure does not require a United States “penalty of perjury” statement unless that requirement is applicable to a separate legally valid process being used.
13. Review of a counter-notice
We will review a sufficiently substantiated counter-notice within a reasonable period. We may forward relevant parts to the original complainant where necessary to assess the dispute, while limiting unnecessary personal data.
We may maintain, narrow, reverse or otherwise modify the restriction. Content will not be automatically restored after a fixed number of days. Restoration depends on the evidence, applicable law, any court or authority action, platform safety and whether continued hosting would expose users or GlobalBay to material risk.
14. Complaints and further redress
Affected users and notifiers may challenge an eligible decision through the NexoRush complaint process by contacting support with the decision reference and supporting reasons. Where applicable, the notice of decision will include information about internal complaint handling, certified out-of-court dispute settlement and judicial redress.
Nothing in this Policy prevents a person from seeking legal advice, contacting a competent authority or applying to a court.
15. Repeat infringement
We may suspend or terminate users who repeatedly or seriously provide infringing content. We consider the number, nature, recency and outcome of notices; the user's conduct; any counter-evidence; and whether the behaviour appears intentional or systemic.
A notice alone does not automatically establish infringement. We will take reasonable care to avoid treating duplicate, clearly abusive or successfully challenged notices as confirmed violations.
16. Misuse of the reporting process
You must not knowingly submit false, deceptive, automated or abusive notices or counter-notices. Misrepresenting ownership, impersonating a rights holder, concealing a licence or using copyright reports to suppress lawful competition may result in rejection, account action and legal liability.
Users who frequently submit manifestly unfounded notices or complaints may have access to the reporting mechanism temporarily restricted where permitted by law, after appropriate warning and assessment.
17. Existing Buyers and removed products
When a listing is restricted, we may also disable future sales and downloads. Existing Buyers may lose the ability to download the product again where continued distribution would be unlawful or unsafe.
Removal does not automatically decide whether a Buyer may continue using a copy lawfully obtained before removal. That question depends on the validity of the rights granted, the reason for removal and applicable law. If third-party rights prevent the licensed use, the Buyer may have remedies for lack of conformity under the Terms, Refund Policy and mandatory law.
18. Freelance deliverables
A copyright complaint may concern a freelance brief, attachment, preview or delivered file. Project confidentiality does not prevent NexoRush from reviewing the minimum material necessary for support, safety, a dispute, legal compliance or rights enforcement.
The allocation of rights in a freelance deliverable is determined by the accepted project terms, any express assignment, the Licensing Terms and applicable law. Payment for a service does not by itself prove that all copyright was assigned.
19. Preservation and disclosure
We may preserve notices, counter-notices, content copies, provenance records, account data, communications and transaction evidence for the period reasonably necessary to handle the claim, prevent repeated abuse, defend legal rights and comply with accounting or legal-retention obligations.
Information may be disclosed to affected parties, professional advisers, service providers, courts, law enforcement or competent authorities where necessary and lawful. Personal data is handled according to the Privacy Policy.
20. No general monitoring obligation
NexoRush is not subject to a general obligation to monitor all stored content or actively seek facts indicating illegal activity. We may nevertheless conduct proportionate voluntary reviews, use technical safety or provenance controls, and act on specific notices, detected risks and legal orders.
Automated indicators may assist review but should not be treated as final proof of infringement without appropriate context and safeguards.
21. Copyright exceptions and mandatory rights
This Policy does not prohibit uses permitted by applicable law, such as a valid quotation, criticism, review, parody, research, education, text-and-data-mining exception, software interoperability exception or another mandatory limitation on copyright. Whether an exception applies depends on the facts and jurisdiction.
NexoRush may request sufficient context to assess a claimed exception but does not provide legal advice to either party.
22. Changes to this Policy
We may update this Policy for legal, regulatory, security or operational reasons. The published version and effective date will identify the current process. Material changes will be notified where required by law.
Changes do not determine ownership retroactively and do not silently rewrite completed licence grants or final decisions. A pending report may be handled under the current legally compliant process where necessary.
23. Governing law and jurisdiction
This Policy is governed by the laws of the Netherlands and applicable European Union law, without prejudice to mandatory intellectual-property, procedural and consumer-protection rules. The competent courts of the Netherlands have jurisdiction unless mandatory law requires or permits another forum.
