Copyright Policy

NexoRush respects intellectual property rights and expects all users to do the same.

This policy explains how copyright and intellectual property matters are handled on NexoRush, operated by GlobalBay.

NexoRush operates as a digital marketplace and acts as the Merchant of Record for all transactions. This policy applies to all sellers, buyers, and visitors of the platform.

1. Platform Role

NexoRush sells digital products to customers and manages transactions as the Merchant of Record. The platform acts as a hosting provider for user-generated content and does not claim ownership of materials uploaded by sellers.

NexoRush complies with applicable EU law including the Digital Services Act (DSA) and the EU E-Commerce Directive regarding hosting liability and notice-and-takedown obligations.

2. User-Generated Content

Sellers are solely responsible for the content they upload. By uploading content, sellers confirm they hold all necessary rights, licenses, and permissions to distribute it on the platform.

3. Seller Responsibility

Sellers must ensure that their products do not infringe any intellectual property rights, including but not limited to copyrights, trademarks, patents, or trade secrets. Sellers indemnify NexoRush against any claims arising from their content.

4. Buyer License

Upon purchase, buyers receive a non-exclusive, non-transferable, personal license to use the purchased product for its intended purpose, as further specified on the product page.

Ownership and all intellectual property rights remain with the seller or original creator. Purchasing a product does not transfer copyright or any other intellectual property rights to the buyer, unless explicitly stated otherwise in writing.

• Reselling, redistributing, or sublicensing purchased products is prohibited unless explicitly permitted
• Reverse engineering or extracting components beyond the scope of the license is prohibited

5. Prohibited Content

The following are strictly prohibited on NexoRush:

• Content that infringes copyright, trademark, or other intellectual property rights
• Unauthorized redistribution of third-party digital products
• False or misleading ownership claims
• Content obtained through unauthorized means or data scraping

6. Reporting Infringement

If you believe your copyrighted work has been infringed on NexoRush, please submit a written infringement notice to:

We will acknowledge valid notices within 3 business days and aim to process them within 5 business days.

7. Notice Requirements

A valid infringement notice must include:

• Identification of the copyrighted work claimed to be infringed
• The URL or product reference of the allegedly infringing content
• Your full name, physical address, email address, and phone number
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf
• Your electronic or physical signature

Submitting a false or misleading infringement notice may expose you to legal liability.

8. Takedown Process

Upon receiving a valid infringement notice, NexoRush may remove or disable access to the reported content without prior notice to the seller. The affected seller will be notified after removal where legally permissible.

NexoRush aims to process valid notices within 5 business days of receipt.

9. Counter Notice

If you are a seller and believe your content was removed in error, you may submit a counter-notice to [email protected] (Subject: Copyright Counter Notice).

A valid counter-notice must include:

• Your full name, physical address, email address, and phone number
• Identification of the content that was removed and its previous location
• A statement under penalty of perjury that you have a good faith belief the content was removed in error
• A statement that you consent to the jurisdiction of the courts of the Netherlands
• Your electronic or physical signature

If the counter-notice is valid, NexoRush may restore the content at its discretion, typically within 10 business days, unless the original complainant initiates legal proceedings.

10. Repeat Infringers

NexoRush maintains a repeat infringer policy in accordance with applicable law. Users who repeatedly upload infringing content may have their accounts suspended or permanently terminated.

11. No Monitoring Obligation

NexoRush is not obligated to proactively monitor user-generated content for infringement, in accordance with Article 8 of the EU DSA. However, NexoRush reserves the right to review and remove any content at its discretion.

12. Limitation of Liability

NexoRush is not liable for user-generated content or disputes between users regarding intellectual property. NexoRush does not guarantee the legality or accuracy of content uploaded by sellers. Liability is limited to the fullest extent permitted by applicable law.

13. Governing Law

This Copyright Policy is governed by the laws of the Netherlands and applicable EU regulations, including the Digital Services Act (DSA) and the EU E-Commerce Directive. Disputes shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, without prejudice to mandatory consumer protection rights under EU law.
